TERMS & CONDITIONS

Deposits & Payments 

1.    The collection/delivery date is considered “booked” upon receipt of a non-refundable deposit equaling 50% of the total value of the order.

2.    The final payment is due 2 days before the collection/delivery.

3.    If the order is booked 7 days or less before the date of collection/delivery, 100% payment is required.

4.    Bespoke orders made within 7 days of the collection/delivery date will incur a last-minute fee.

5.    If the Client fails to make payments, THE CUPCAKE NEST will cease work, the order will be cancelled and no refund will be given.

6.    The preferred method of payment is Bank Transfer.

7.    The Client will have a grace period of 2 days after the payment due date to pay the debt before the contract is cancelled.

 

Liability

1.    THE CUPCAKE NEST is not responsible for bodily injury, property, or consequential damage, that may result from services.

2.    THE CUPCAKE NEST is not responsible for any damage to the order or shortage of the order caused by anyone NOT employed by THE CUPCAKE NEST.

3.    THE CUPCAKE NEST will not deliver or hand over an order if payments have not been paid in full.

 

Fulfilment of Contract

1.    THE CUPCAKE NEST is not responsible for any delay or inability to deliver based on accidents, natural disasters, transportation issues, inclement weather, illness, death, labour troubles, delay in supplies, disputes or strikes, or any other circumstance beyond THE CUPCAKE NEST’s control.

2.    If THE CUPCAKE NEST has completed the order but it can’t be delivered due to uncontrollable circumstances, the Client will be refunded 100% of the total cost.

3.    If the Client picks up the cake, THE CUPCAKE NEST no longer assumes any responsibility for damage caused to it. 

 

Postponement/Cancellation

1.    The Client must notify THE CUPCAKE NEST if there is a change in the date of the collection/delivery or a complete cancellation.

2.    No penalty fee will be charged if the postponement occurs 5 days before the original collection/delivery.

3.    If a cancellation occurs 7 days before the date of the collection/delivery, all money will be refunded minus the deposit fee.

 

Changes to Order

1.    Any changes must be submitted 7 days in advance.

2.    The Client will receive imagery of the finalised product 1 day ahead of collection/delivery. 

3.    If the Client is unhappy with the order, changes must be notified immediately. 

4.    Only minor changes or errors will be rectified.

Design of the Order

1.    THE CUPCAKE NEST will follow the Client’s requests closely to create the exact order desired.  

2.    THE CUPCAKE NEST cannot duplicate an exact copy of another cake artist’s work but will ensure the look is similar.

 

Allergy & Dietary Warnings

1.    THE CUPCAKE NEST’s baked goods may have come in contact with the following ingredients: 

•     Nuts

•    Peanuts

•    Eggs

•    Milk

•    Gluten

2.    All listed allergens are used in the kitchen; milk, eggs, soybeans, lupin, celery, crustaceans, fish, sulphur dioxide and sulphites, cereals containing gluten (such as barley and oats), tree nuts, peanuts, and sesame. 

3.    Natural dyes, artificial dyes, artificial flavourings, sugar, artificial sweeteners, artificial colours, and other allergens not listed.

4.    THE CUPCAKE NEST and its affiliates will not be liable for any adverse reactions from any products consumed or other items that individuals may come into contact with whilst eating any of THE CUPCAKE NEST's and its affiliate's products.

5.    The Client is responsible for pointing out to guest’s potential allergy hazards.

 

Delivery, Collection, and Set Up

1.    The delivery fee starts from £5. Delivery can be made in the Dartford, and London areas.

2.    The Client is responsible for providing the delivery address 2 days ahead of delivery.

3.    If the Client does not provide an address, the Client is responsible for collecting the order.

4.    THE CUPCAKE NEST is not responsible for tardiness if the venue is changed within 48 hours of the collection/delivery.

5.    The Client may pick up the order. The Client assumes liability once it passes into the Client’s possession.

6.    All orders must be collected from the Dartford area. Please make sure you stick to the agreed time, as schedules are planned to fit your time slot. The address will be provided 2 days before collection.

7.     When collecting your order, please hold the bottom of the box to prevent damage and movement of the order. 

8.     Transport your order in the passenger footwell of the car as this is the flattest surface. Please do NOT place cakes on a lap or car seat, as it may cause damage. Please ensure you have the air-con on as buttercream and cream cheese can melt very quickly.

9.    Store cakes in the fridge and serve at room temperature.

10.  The Client is responsible for providing a suitable environment for the order (away from heaters, vibrations, people, suitable surfaces, and a suitable outdoor setting). 

 

Photographs

1.    THE CUPCAKE NEST reserves the right to use all photographs of the order for advertising purposes.
